APPENDIX F – Severe Repetitive Loss Policies F.1 Introduction The primary insurance objective of the repetitive loss properties strategy is to change the exposure status of repetitive loss properties, especially the Severe Repetitive Loss (SRL). Success will be achieved when properties, having completed the requirements of the strategy sustain minimal (less than $1,000.00), if any, damage when exposed to previously experienced flooding conditions. The mitigation approach will include FEMA’s mitigation branch or its designee offering voluntary mitigation assistance to policyholders within the program. These offers may include elevating the structure, flood-proofing commercial structures, removing the structure from the floodplain, or the purchase of the property by the community. The insurance approach will be for WYO companies to begin transferring the identified properties to the Special Direct Facility (SDF) of the NFIP Direct Servicing Agent beginning with August 1, 2000 renewals. F.2 Section 1 – General Procedures F.2.1 Data Submission Schedule The NFIP Bureau will notify the WYO companies of the identified SRL properties at least 150-days prior to the last day that the additional data record for the identified policies must be sent to the NFIP Bureau via Additional Data Record. On May 1, 2000, the SDF began to service SRL policies on or after the August 1, 2000 effective dates. The Additional Data Record file supplements TRRP Plan data with additional policy information, which is a required WYO company submission. This data is processed and forwarded to the SDF at the Direct Servicing Agent. The WYO company Additional Data Record layout is in this section. The data submission schedule is as follows. Activity Date Report/file sent to individual WYO companies identifying properties in the entire target group (now SRL) for the company. February 29, 2000 and thereafter SDF assumes responsibilities for handling any disputes from WYO company and/or insured. April 1, 2000 and thereafter First additional data file received by NFIP Bureau from companies for the identified properties that will renew in 90 days. April 30, 2000 and thereafter The monthly report/file identifying the non-renewal report. Policies will appear 120 days after expiration. December 30, 2000 and thereafter WYO companies must submit the Additional Data Records in the same manner as TRRP data. Effective on May 1, 2009, WYO companies will be required to submit this file with the new layout once a month at the same time as the NFIP Monthly TRRP file. WYO companies that comply with the schedule will be held harmless if the policy is not renewed. F.2.2 Bureau Processing The SRL policies dataset is created and maintained by the NFIP IT Services within the NFIP Data Warehouse. Any renewal of an SRL policy that has had 150-days notice will receive the TRRP error PL004086 (SRL Policy Renewed in Error). The W2RPINVD report will reflect this error. If the NFIP Bureau does not receive the additional data record 90-days before expiration, the policy will receive TRRP error PL004087 (Repetitive Loss Additional Data Record Not Received Nor Was a Cancellation Record) for the term. F.2.3 Appeals Procedure In the event a policyholder chooses to appeal the decision that their insured property is a repetitive loss property, a 90-day appeal process will allow the policyholder to make a case contrary to the NFIP Bureau’s Data Warehouse. A policyholder appeal will be made directly to the SDF. The SDF may request additional claims records or other documentation from the involved WYO companies and/or NFIP Bureau to support the appeal process. The 90-day appeal process begins on the date of the policyholder’s letter or other notice to the SDF. F.2.4 Identification The NFIP IT Services identifies a SRL property based on SRL logic within the NFIP Data Warehouse. Properties are identified based on loss history by location/address without regard to ownership or changes in ownership. A Location ID is marked as a RL or SRL in the NFIP Data Warehouse, if it meets the RL or SRL criteria. The SDF conducts the following activities starting May 1, 2000. . Process policies and claims for the identified SRL properties that have been submitted via Additional Data Record . Evaluate property inspections, elevation certificates, GPS data, and zone verification for each SRL . Support insured SRL appeals . Support tracking SRL property activities for mitigation purposes F.2.5 Notification When an SRL property is identified, the NFIP Bureau will notify WYO companies at least 150-days prior to the last day that the additional data record for the identified policies should be sent to the NFIP Bureau. TheBureau will forward both the additional record and the corresponding TRRP data in the agreed upon format to the SDF. Once the records are received by the SDF, the affected policyholders, their agents, and WYO companies will be given notice of the implementation of the SRL program. This notice, which will be a part of the renewal offer from the SDF, will inform all of the affected interested parties of the special renewal process. The notice will inform the policyholder and WYO company that these properties are ineligible for coverage outside of the SRL property program. These SDF renewal offers will be sent to the policyholders at least 45-days prior to the expiration date of the policy. This special renewal procedure will be in effect for the initial renewal offer for the initial group as well as all newly identified SRL properties at their first renewal. Information relative to all SRL properties will be retained in the NFIP Data Warehouse, which is maintained by the NFIP IT Services, to assure that the identified policies are covered and renewed only through the SDF and that new policies cannot be written for the identified SRL properties by WYO companies. SRL properties are considered ineligible for WYO Companies and should only be written or renewed by the SDF. Each Location ID in the NFIP Data Warehouse has one of the following statuses. . Non RL . RL Mitigated . RL Non-Mitigated . SRL Mitigated . SRL Valid Appealed . SRL (only status where a WYO company cannot write/renew a policy) Each location ID status is associated with one or more property addresses and will be updated as SRL properties are marked with a status. WYO companies will only receive files/reports with the SRL status. After the initial SRL renewal process, the SDF will generate a month-end report identifying those policies that did not renew that month. This data file will be sent to the NFIP IT Services, which will forward it to the affected WYO companies and NFIP Business Services. These properties will continue to have the status “SRL” and be ineligible for coverage outside SDF. If a WYO company writes a new business (11A) policy on a SRL property for which the company has not yet received notice as being part of the SRL, the policy may be written by the WYO company for 1 year. After that initial year, the policy will need to be renewed at the SDF. Such a situation may occur, for example, if the property is an SRL property, but not insured by the NFIP at the time the list of currently insured SRL properties is prepared. If a WYO company writes a policy on a property that is currently identified as being part of the SRL, the NFIP Bureau will notify the WYO company through the TRRP Cycle error process. These policies will receive error code PL004086. F.2.6 Removal from the SRL If the property is certified by FEMA with respect to any mitigation or insurance effort (other than buyout or demolition) including elevation, relocation, or other approved mitigation efforts, the property status will change to ‘SRL Mitigated.’ A property with the ‘Mitigated’ status is on the SRL files/reports for the WYO companies and may be written at a WYO company. Once the SDF receives written notice of FEMA’s official approval of the mitigation effort to the insured property or a report/file from the NFIP IT Services, a notice will be sent to the policyholder and the agent of record. The notice will inform the policyholder that, upon the next renewal, the policy will no longer be eligible to be written by the SDF. The policyholder will be notified that an NFIP Direct renewal offer will be sent to make sure the policyholder has the opportunity to maintain continuous coverage and that the policy may be written by a WYO company at the next renewal, but not before. Any property with 2 or more losses in a 10-year rolling period. If there are 2 losses within in 10-days of each other only 1 of those losses is counted. This is only used for selecting a property. 2. In order for a loss to be considered a RL, it must be on or after the 01/01/1978, closed and have at least $1,000 in payments. In addition, a property is considered not to be repetitive if one of the following types are checked (or switches) are set in the AW501 and RL Maintenance application. . Flood Protection Provided (status changes to ‘Mitigated’) . No Building on Property (status changes to ‘Mitigated’) . To show on this report, the property must be currently insured. To accommodate late renewals and other situations, the SRL report will include policies that have expired less than 120-days ago. Policies with status codes for future effective, future cancellation, and reinstated will be included. 4. The property must have 4 or more losses or 2 to 3 losses with a cumulative building loss greater than the property value (contents payments are not a deciding factor). The Property value is determined by taking the most recent property value of ‘RCV’ if it is available. If it is not available, then the most recent property value of ‘ACV’ is used. If the value from the most recent date of loss is unacceptable, then the next date of loss is checked in the same manner until an acceptable value is found. If no acceptable value is found, then the most recent date of the loss is used. An acceptable value is a non-zero value less than $10 Million for 1 to 4 Family Property or a non-zero value less than $100 Million for properties that are Other Residential or Non-Residential. During the process of checking for an acceptable value, if multiple occurrences of flooding are found for any Date of Loss then ‘Assumed CONDO’ will be in the Property Value Field. If no acceptable value is found then ‘Val Not Avail’ will be used in the Property Value field.
